Terms of Service

My TOS is to be understood by all commissioners. By commissioning me, you agree to the following information.

Payment

All payments will be handled through PayPal invoices or Ko-fi. At least 50% of the payment must be made before any work is done. High res, un-watermarked files of finished work will not be delivered until full payment is made.

Refund Policy

Refunds are not available unless the artist decides they cannot fulfil the commission and no work has been done.

Cancellation

If you need to cancel a commission, you may do so. If no work has been done, a full refund can be issued. If work has been done, at least 50% of the payment will be kept.

Rights & Usage

The artist retains all rights to artwork they create. The commissioner does not gain rights to the provided work through commission. If the commissioner wishes for commercial rights, it may be discussed between the commissioner and the artist for an additional fee.

Reproduction/Reselling

The client may not use any commission purchased for reproduction or merchandise unless discussed with the artist. Any and all reproduction or reselling of the work will be reported and will have legal action taken against if needed.

Content

The artist reserves the right to refuse any idea or request. For an estimated list of what is acceptable, please ask the artist.

WIPs & Edits

Sketch WIPs will be provided to all commissioners unless the purchase made is 'skeb-style' in which the artist will wing the commission based on description and references provided. Further WIPs of standard commissions must be requested by the commissioner before payment, and will result in additional fees. Changes must be made during the WIP checkpoints. Changes WILL NOT be made after completion of the commission unless the error is on the fault of the artist and is incorrect to a picture reference.

Posting, Tracing, Stealing

At any point the commissioner may post their commission to their social media pages, and use the commissions for icons, emotes, stickers, etc even if that is not their intended purpose. The commissioner is required to provide proper credit in all instances in a clear and public location where the artwork is displayed.

Only the artist and the commissioner may post the commissioned work to their social media. If another party is present in the commission, they may request the right to post it from the commissioner and must provide credit of the work to the artist where-ever the commission is posted.

Commissions are NOT allowed for posting by parties not involved in the commission (repost accounts, themed accounts for the subject, third-party sites, etc). If one is found to do so, the artist has the right to file a copyright infringement report and take legal action if needed.

Commissions are NOT allowed for physical creation (prints, merch, etc) without the permission of the artist. Depending on intended use of the physical media, fees may be applied.
Tracing or heavy referencing of commissioned work is prohibited by the artist and if found, the artist has the right to file a copyright infringement report and take legal action if needed.

Wait Times

Commissions can take anywhere from a month to several months to do. The commissioner will understand this and expect a possible long wait time. Due to a fulltime job, the artist will not be able to consistently work on the commission fulltime which can result in delays, on top of life situations and events. If the commission is unexpectedly delayed by events or situations, the artist will inform the commissioner of this.
